Regulatory Framework for the Accreditation of Authorized Registrars for Yemeni Domain Names (.ye)

Yemeni Domain Name:

Any Latin domain name under the Yemeni Top-Level Domain (TLD) is called a “Domain Name.”

Latin Domain Name:

A domain name with Latin labels separated by dots, as follows:

• Two labels: (example.ye), where (.ye) is the rightmost label.
• Three labels: (example.com.ye), where the rightmost two labels form a main second-level domain, such as (.com.ye) or (.edu.ye).

Latin Label:

A Latin label consists of letters (A–Z), digits (0–9), and hyphens (-), and is case-insensitive.

Reserved Name:

Words or expressions not allowed in Yemeni domain names, listed by the Registry Operator as “Reserved Names.”

Registration Services:

The registry provides all services related to the registration of Yemeni domain names, including, but not limited to, registration, modification, deletion, cancellation, renewal, suspension, or transfer of a domain name.

Applicant:

Any person who submits a request for domain name registration to an Accredited Registrar or an authorized reseller.

Registrant:

A natural or legal person whose application is approved. This term also includes holders of existing Yemeni domain names whose registrations comply with this document.

Premium Domain Name:

A domain name with a short length or special value, such as two- or three-character names, city or region names, personal names, or widely recognized commercial terms. The Registry Operator classifies these.

Registration Agreement:

A service agreement between the Accredited Registrar and Applicant, made through a service request and following Registry Operator rules.

License:

A document from the Registry Operator authorizing the Accredited Registrar to provide registration services under the relevant rules.

Confidential Information:

Confidential Information includes any information, material, or tool that is classified or deemed confidential, including but not limited to software, data, information, intellectual property, data structures, protocols, implementation references, documentation, financial information, statistics, functional specifications, and interfaces.

Personal Data:

Any information about an identified or identifiable person.

Effective Date:

The date when the Accredited Registrar gets notice of license approval.

Registrar Agreement:

A service agreement between the Registry Operator and Accredited Registrar, made through a service request.

Registry Operator Database:

A database stores details for Yemeni domain names. It is used to create DNS records or to respond to domain search and directory queries.

License Term:

The license period starts on the Effective Date and lasts until it ends.

2. Scope of the Document

This document applies to all Accredited Registrars for Yemeni domain names.

3. Eligibility and Licensing Requirements

3.1

The Registry Operator sets rules for who can get a domain name and related services, licenses, and activities.

3.2

When applying, the entity must be a local legal business in telecommunications or IT, and must be licensed. This must stay true throughout the license term.

3.3

To obtain a license, the applicant must fulfill the following requirements:

  Submit the completed application form signed by an authorized representative.
• 3.3.2
  Submit a detailed proposal including:

• 3.3.2.1 Technical plan for integration with the Registry System.
• 3.3.2.2 Mechanism for providing registration services to end users.
• 3.3.2.3 Marketing plan for Yemeni domain name services.
• 3.3.2.4 Customer technical support services.
• Describe how you will ensure applicants follow the rules set by the Registry Operator, including:
• 3.3.3
  Payment of the financial obligations as specified in Annex (2) – Financial Consideration and Tables (1–2).
• 3.3.4
  The contractor must successfully pass the required tests for integration with and use of the registration system, and fulfill the business and technical requirements specified in Annex (1).
• 3.3.5
  Once you meet all requirements and sign the agreement, you will get the license.

4. Registration System

4.1
During the license term, the Accredited Registrar will have access to the Registry System. This access is granted in accordance with the requirements and procedures approved by the Registry Operator for the provision of registration services.

4.2
The Accredited Registrar shall bear full responsibility for all domain name records associated with it within the Registry System.

4.3
The Registry Operator shall have the right to suspend the processing of the Accredited Registrar’s requests in order to protect the technical integrity and operational stability of the Registry System, or if it is determined to be necessary by the Registry Operator at its sole discretion.

4.4
The Registry Operator may, from time to time, make changes to the Registry System. These changes can include changes to tools, platforms, or access methods. The Registry Operator will notify the Accredited Registrar within a reasonable period, as needed.

5. Obligations of the Accredited Registrar
6. General Obligations

5.1
The Accredited Registrar shall comply with the Regulation. The Registrar must also follow all rules, instructions, and procedures from the Registry Operator, as well as the license terms and the Registrar Agreement.

5.2
The Accredited Registrar shall provide domain name services to beneficiaries on request, without discrimination. The Registrar must keep registrants’ domain names within the Registry System and ensure the information is accurate and current. The Registrar may collect fees from registrants in accordance with the Registry Operator’s instructions.

5.3
The Accredited Registrar shall notify registrants of the impending expiration of their domain name registrations and the requirement to renew them within a specified period, in accordance with the rules and procedures approved by the Registry Operator.

5.4
The Accredited Registrar shall execute a service agreement with registrants, as approved by the Registry Operator.

5.5
The Registration Agreement shall include the registrant’s acknowledgment and acceptance of the following:

• 5.5.1
  Acknowledgment of, and compliance with, all relevant provisions in the Regulation and any rules or guidelines issued by the Registry Operator for Yemeni domain name registration.
• 5.5.2
  The Registry Operator shall have the right to transfer the registrant’s domain name to another Accredited Registrar whenever it deems necessary.
• 5.5.3
  Commitment to comply with dispute resolution procedures and to be bound by the decisions arising therefrom.
• 5.5.4
  Confirmation that all information and documentation related to the domain name or service request are complete, accurate, and up to date.
• 5.5.5
  Acknowledgment that the Registry Operator may enforce regulatory provisions in the Registration Agreement and rules for Yemeni domain name registration without liability.

·        5.5.6
The Registration Agreement shall not contain any provision or clause that conflicts with the Accredited Registrar’s obligations toward the Registry Operator or with any applicable laws and regulations. The same requirements shall apply to any amendments made to the Registration Agreement.

5.6
The Accredited Registrar shall bear full responsibility for its resellers and for their compliance with all provisions of the Regulation and any applicable rules or approved instructions.

5.7
The Accredited Registrar shall establish clear procedures for promptly responding to and handling complaints submitted by registrants and applicants in relation to domain names, and shall provide and publish an emergency contact number.

5.8
The Accredited Registrar shall implement the necessary procedures and utilize appropriate tools to securely access or integrate with the Registry System, ensuring the protection of all data exchanged between the Registrar and the Registry System.

5.9
The Accredited Registrar shall apply internationally recognized information security best practices and take all necessary measures to safeguard data, maintain its confidentiality, and prevent its disclosure to any third party except as required by applicable laws.

5.10
The Accredited Registrar shall provide high-quality services through clear, efficient procedures and shall facilitate access to domain registration services through multiple integrated channels, including websites, mobile applications, and physical service offices.

5.11
The Accredited Registrar shall undertake all necessary measures to promote the service and increase registration demand, including advertising and marketing campaigns, awareness and promotional initiatives, and entering into agreements with multiple resellers, among others.

5.12
The Accredited Registrar shall allocate and maintain sufficient qualified personnel to manage and deliver the services, ensure service continuity, and respond to registrants’ complaints and resolve issues in a timely manner.

5.13
The Accredited Registrar shall deliver and manage services and process registration requests using modern, appropriate electronic systems that ensure efficiency, effectiveness, and competitiveness, in accordance with internationally recognized standards.

5.14
The Accredited Registrar shall verify the readiness and eligibility of its resellers and ensure they deliver services at the highest quality and performance levels.

5.15
The Accredited Registrar shall use communication channels approved by the Registry Operator, including email and official correspondence.

5.16
The Accredited Registrar shall provide the required contact information and maintain its accuracy and currency throughout the license term.

5.17
The Accredited Registrar shall specify the applicable fees for registration services to applicants and publish them on its website.

5.18
The Accredited Registrar may implement a mechanism that enables registrants to offer their domain names for transfer, provided the Registrar discloses this mechanism, its procedures, and related fees to the public. The Accredited Registrar shall ensure pricing neutrality, safeguard confidential pricing information, and avoid favoring any party, except as directed by the Registrar’s published and Registry Operator-approved procedures. The Registry Operator may issue regulations or guidelines for such a mechanism.

5.19
The Accredited Registrar shall submit any requested information and documentation to the Registry Operator within the specified timeframe, in the prescribed format and method.

5.20
The Accredited Registrar shall implement decisions issued by the Registry Operator in accordance with the powers stipulated by applicable laws and regulations.

5.21
The Accredited Registrar shall re-verify the accuracy of the registration information upon the Registry Operator's request.

5.22
The Accredited Registrar shall not engage in, or participate in, any practice or activity involving the warehousing of domain names for the purpose of preventing their availability to others.

5.23
The Accredited Registrar acknowledges that obtaining a license does not grant it any preferential treatment over other Accredited Registrars in accessing the Registry System.

5.24
The Accredited Registrar shall retain and maintain all information and records related to service requests—whether directly or indirectly—including, but not limited to, IP addresses and payment information of applicants, for a period of no less than two (2) years from the date of the service request. Such information and records shall be made available to the Registry Operator upon request.

5.25
The Accredited Registrar shall not involve the Registry Operator in any dispute or claim relating to the registration or use of a domain name, including any subdomains thereof.

5.26
The Accredited Registrar shall accept requests for the transfer of a domain name from the registrant to another Accredited Registrar.

1. Technical and Security Standards

5.27
The Accredited Registrar shall comply with all applicable regulations and procedures in force within the Republic relevant to the provision of services, while adhering to internationally recognized best practices concerning operational, technical, quality, and performance standards for domain name registration services and related services provided to its customers.

5.28
When using or accessing the Registry System, the Accredited Registrar shall provide complete and accurate data in accordance with the Registry System's technical specifications.

5.29
The Accredited Registrar shall fulfill all technical requirements necessary for integration with and operation of the Registry System, as specified in Annex (1), including qualified human resources, hardware, software systems, and other relevant components.

5.30
The Accredited Registrar shall develop and implement appropriate solutions and technologies to ensure the integrity and security of services related to the registration of Yemeni domain names, including securing connectivity to the Registry System and securing its own systems, website, and associated services. The Registrar shall also apply recognized technical and security standards and comply with any standards or controls issued by the Registry Operator or competent governmental authorities.

5.31
In the event of any breach or security threat affecting the Accredited Registrar’s operations, its connection to the Registry System, Yemeni domain names, or registrant information, the Accredited Registrar shall promptly notify the Registry Operator immediately upon becoming aware of such incident.

5.32
The Accredited Registrar shall cooperate with the Registry Operator in audit and inspection activities aimed at verifying the Registrar’s compliance with these regulations, and shall respond to any related requirements in this regard.

1. Data Privacy

5.33
The Accredited Registrar shall ensure the confidentiality of registrants’ personal data and shall not access such data except in accordance with applicable procedures and regulations governing the protection and processing of personal data, as issued by the Registry Operator or competent governmental authorities.

5.34
The Accredited Registrar shall, when processing personal data, comply with all applicable laws and regulations.

5.35
The Accredited Registrar shall implement appropriate technical and organizational measures to protect personal data against unauthorized access, disclosure, alteration, or deletion.

5.36
The Accredited Registrar shall not use, or permit the use of, personal data in any manner inconsistent with applicable laws and regulations governing data privacy and protection. This includes, without limitation, the use of registrants’ personal data—such as contact numbers, mailing addresses, or email addresses—obtained for the purpose of providing registration services, for marketing campaigns, or the sale of databases containing such data to third parties without the explicit prior consent of the data subject.

5.37
The Accredited Registrar shall maintain the confidentiality of its customers’ data and service users’ information, and shall protect their privacy and the confidentiality of their account information.

1. Confidentiality and Non-Disclosure

5.38
During the license term, the Registry Operator may disclose Confidential Information to the Accredited Registrar. Accordingly, the Accredited Registrar shall, when using or disclosing such information, comply with the following:

• 5.38.1
  The Accredited Registrar shall not use any Confidential Information of the Registry Operator except for the purpose of exercising its rights or performing its obligations under these regulations, and for no other purpose whatsoever.

• 5.38.2
  The Accredited Registrar shall not disclose any Confidential Information of the Registry Operator to any third party without the prior explicit consent of the Registry Operator.

• 5.38.3
  The Accredited Registrar shall not alter or remove any notice or indication denoting the confidentiality of the information or any proprietary rights therein.

• 5.38.4
  The Accredited Registrar shall not prepare, produce, distribute, or publish any works derived from Confidential Information in its possession.

• 5.38.5
  All information exchanged with the Accredited Registrar shall be deemed Confidential Information unless otherwise specified by the Registry Operator.

6. License Renewal

6.1
The license term for the Accredited Registrar shall be one (1) year, automatically renewable for successive terms of equal duration, unless either the Accredited Registrar or the Registry Operator notifies the other of its intention not to renew at least ninety (90) days prior to the expiration of the license term.

6.2
Failure to renew the license shall be subject to the provisions of Clause (13.3) of this document.

7. Suspension and Revocation of the Accredited Registrar License

7.1
The Accredited Registrar may request the termination of its license by submitting a formal request to the Registry Operator at least ninety (90) days prior to the cessation of its services as an Accredited Registrar.

7.2
The Registry Operator may suspend or revoke the Accredited Registrar’s license in the following cases:

• 7.2.1
  If it is determined that inaccurate or misleading information was provided in the license application or in any supporting documents.

• 7.2.2
  If the Accredited Registrar is subject to a final judgment issued by a competent court relating to breach of trust, financial misconduct, fraud, or violation of fiduciary duties, or any judicial ruling deemed by the Registry Operator to be equivalent to such offenses.
• 7.2.3
  If the Registry Operator determines that the Accredited Registrar is engaging in activities or practices that violate applicable laws, regulations, or public policies in the Republic of Yemen.

• 7.2.4
  If the Accredited Registrar fails to remedy or correct any breach of this document within a period not exceeding thirty (30) days from the date of notification.

• 7.2.5
  If the Registry Operator establishes that the Accredited Registrar has failed to provide the registration services stipulated in the license as set out in Annex (3).

• 7.2.6
  If the Registry Operator determines that the Accredited Registrar is engaged in practices that pose a risk to the stability or integrity of internet services or the Registry System, and the Registrar fails to remedy such practices within a period not exceeding seven (7) days from the date of notification.

• 7.2.7
  If the Accredited Registrar becomes bankrupt, files for bankruptcy, is declared insolvent, is placed under receivership, or, in the case of a company, is dissolved or liquidated.

7.3 Upon Revocation of the License:

• 7.3.1
  The Accredited Registrar shall complete all registration and renewal processes for domain names submitted prior to the effective date of the revocation decision, as determined by the Registry Operator, subject to the payment of the applicable fees.

• 7.3.2
  All outstanding fees due to the Registry Operator shall become immediately payable.

• 7.3.3
  The Accredited Registrar shall transfer all domain names under its sponsorship to the Registry Operator or to another Accredited Registrar, as directed by the Registry Operator.

• 7.3.4
  The Registry Operator shall have the right to transfer all domain names under the Accredited Registrar’s sponsorship to itself or to another Accredited Registrar, with the transferring Registrar bearing all associated costs.

• 7.3.5
  The Accredited Registrar shall return all information in its possession to the Registry Operator or destroy such information, as determined by the operator. Operator.

8. Use of Intellectual Property Related to the Registry Operator’s Name, Website, and Trademarks

8.1
During the license term, the Accredited Registrar is granted a non-exclusive, worldwide right to:

• 8.1.1
  It represents itself as an Accredited Registrar authorized by the Registry Operator to register Yemeni domain names.

• 8.1.2
  Use the Yemeni Top-Level Domain (TLD) logos for advertising, marketing, and domain name registration purposes.

• 8.1.3
  Use website addresses associated with such logos.

The Accredited Registrar shall not use the Registry Operator’s name, website, or trademarks for any purposes other than those specified above. For the avoidance of doubt, such use shall not grant the Accredited Registrar any right, title, or interest in or to such intellectual property, except as expressly provided herein.

9. Fees

9.1
The Accredited Registrar acknowledges and agrees that all fees paid to the Registry Operator for registration services—including the registration and renewal of domain names—are non-refundable.

9.2
The Accredited Registrar shall pay all applicable fees on a periodic basis (ranging from one to three months), provided that such payments do not exceed the amount of the bank guarantee within the specified period. In the event of non-payment within the specified timeframe or exceeding the bank guarantee amount, the Registry Operator shall have the right to limit the services available to the Accredited Registrar, including suspending one or more registration services, such as domain name registration or renewal.

9.3
The Registry Operator reserves the right to amend the fees set forth in Annex (2), whether by increase, decrease, addition, or cancellation, provided that such amendments shall become effective ninety (90) days after notification to the Accredited Registrar.

9.4
The Accredited Registrar shall verify the applicable fee for any domain name prior to its registration, renewal, or transfer, in accordance with the mechanism provided by the Registry Operator. The Accredited Registrar shall be responsible for any fees arising from requests submitted through its own registration systems.

9.5
All fees are exclusive of applicable taxes.

9.6
The Accredited Registrar acknowledges its responsibility to collect and pay any applicable taxes or governmental fees.

10. Procedures for Verifying the Accredited Registrar’s Compliance

10.1
The Registry Operator shall have the right to take all necessary measures to verify the Accredited Registrar’s compliance, including, but not limited to, the following:

• 10.1.1
  Conducting periodic or selective random audits of registrant applications, agreements, and supporting data and documentation.

• 10.1.2
  Direct communication with registrants or relevant entities to verify the accuracy of registration information.

• 10.1.3
  Performing periodic technical testing of the Accredited Registrar’s infrastructure and systems.

• 10.1.4
  Conducting on-site inspections of the Accredited Registrar’s premises, where necessary, to assess operational procedures and compliance with the Regulation and the rules and guidelines issued by the Registry Operator.

11. License Transfer

11.1
The license is personal to the Accredited Registrar and may not be assigned, delegated, or transferred to any third party without the prior approval of the Registry Operator. The Accredited Registrar shall notify the Registry Operator of any changes in its administrative structure (such as acquisition, merger, or otherwise).

12. Communication

12.1
All notices and communications shall be made electronically in the manner and form determined by the Registry Operator, and shall be deemed received upon delivery to the contact details provided by the Accredited Registrar.

12.2
Any notice shall be deemed received by all Accredited Registrars if it is announced and published by the Registry Operator on its website or through the Registry System control interface.

12.3
The Accredited Registrar shall be solely responsible for ensuring that its contact information is accurate, complete, and up to date at all times. The Registry Operator shall not be liable for any failure to receive notices or communications due to incorrect or outdated contact information.

13. Final Provisions

13.1
This document shall be governed by and construed in accordance with the laws in force in the Republic of Yemen.

13.2
This document shall be subject to periodic review by the Registry Operator and shall be updated accordingly.

13.3
The Arabic language shall be the governing language for the interpretation and implementation of these regulations. A foreign language acceptable to the Registry Operator may be used for communication purposes in applying these regulations, in whole or in part, alongside Arabic. In the event of any inconsistency between the Arabic and foreign language versions, the Arabic version shall prevail.

Annex (1) – Commercial and Technical Requirements

The applicant for accreditation as an Accredited Registrar shall comply with the following requirements in order to obtain accreditation:

The applicant for accreditation as an Accredited Registrar shall provide the required infrastructure and technical capabilities. The license shall be granted upon fulfillment of such requirements and successful completion of the technical tests.

Annex (2) – Financial Consideration

Table (1): Registrar Accreditation Fees

1. All amounts above are in US Dollars (USD) and do not include taxes.
2. TeleYemen may amend the application and licensing fees at its discretion.
3. The Accredited Registrar shall provide the above-mentioned bank guarantee as security for the fulfillment of its financial obligations. Such guarantee shall be refunded upon the termination of its accreditation, provided that no outstanding amounts are due to the Registry Operator. In the event that any amounts remain outstanding, the Registry Operator shall have the right to deduct them from the bank guarantee.

Annex (3) – Core Registration Services (Minimum Requirements)

• The Accredited Registrar shall provide, at a minimum, the registration services set out in the table below:
